As a law firm, Moriarty Law believe in clarity so if
there is any question about the legitimacy of the amount owed, we are happy to
investigate any concerns raised.
We use ‘Alternative Dispute Resolution’ at each stage of
our instruction and invite you to send to us any documentation you believe will
assist in dealing with your query. For example, if you believe the debt has been
paid previously, providing Moriarty Law with evidence can aid in investigations
when referring back to our client.
We have provided the information as set out below in order
to give you further details on how to dispute a case at each stage of the legal
process.
Moriarty Law recommends that you seek your own independent legal advice.
·
Not In
Court / Pre Litigation – Please Contact Us to discuss, we are happy to
provide all additional information we may hold in relation to the case, we can
advise of and investigate any queries where necessary and provide documentation
as required. The Pre Action Protocol
response pack sent alongside our first communication, gives full details of how
to raise with us an account query.
·
County
Court Claim Issued – Please Contact Us to discuss, we are happy to provide
all additional information we may hold in relation to the case, we can advise
of and investigate any queries where necessary and provide documentation as
required OR respond to the Claim Pack (sent direct from the County Courts)
which includes a response pack. Please note that we recommend you seek your own
independent legal advice regarding how to respond to the Claim Pack as we
cannot provide legal advice. Filing a defence or defence and counter claim will
inevitably result in the case going to a hearing in front of a District Judge
where a ruling will be made based on evidence.
·
County
Court Judgment Has Been Registered – The Courts will have ruled in our client’s
favour if a Judgment has been made, which will mean you have deemed legally
liable to pay as per the Judgment. You are still able to Contact Us to discuss
where we are happy to provide additional information we may hold in relation to
the case, we can advise of and investigate any queries where necessary and
provide documentation as required OR seek
your own independent legal advice.
·
Enforcement
Proceedings Issued – The Courts will have ruled in our Client’s favour if a
Judgment has been made, which will mean you have been deemed legally
liable to pay. You are still able to Contact Us to discuss where we are happy
to provide additional information we may hold in relation to the case which we
can advise of. Usually once the case has been transferred for Enforcement, the
details are transferred to the Courts to deal with. Please note that if a Writ
of Control has been issued by the High Court, we are unable to provide
assistance as all dealings and communications must go through the High Court
Enforcement Officers appointed to act.
